Policy and Procedures
Mile Run East Master Association, Inc.
The Master Declaration of Covenants and Restrictions, Article V, provides the Board of
Directors shall serve as the Architectural Control Committee ("ACC").
1. Article V stipulates "No construction of any building, fence, wall, mailbox or
other improvement or structure shall be commenced, erected, placed, moved or maintained
upon the property, nor shall any addition to or change or alterations to the exterior
or the color thereof be made until sufficient plans and specifications and colors have
been submitted to the ACC and unless such have been approved in writing as to harmony
of external design, color, materials, and location in relation to surrounding structures
and environment and conformity with the design concept of the community by the ACC. "
2. The ACC is vested with authority to publish " …rules and regulations regarding
the form and content of plans and specifications to be submitted for approval."
3. Owners are required to "… keep their lots mowed and properly maintained at all
times, at a level equal to the better maintained lots, as determined by the ACC, in Its
sole judgment."
4. Owners are required to " …repair such owner’s dwelling unit and other improvements,
keeping the same in a condition comparable to the condition of such residence and other
improvements at the time of Its initial constructions excepting only normal wear and tear,"
5. The Master Declaration of Covenants and Restrictions, Article VI, lists specific
Restrictive Covenants. In pertinent part, these Covenants provide:
"No lot shaft be re-divided unless approved by the ACC "
“No trades business, service, professional care, instruction of manufacturing of
any kind or nature whatsoever shall at any time be conducted on any of the property,.."
“No part of the property, or any improvements erected or placed thereon shall
be used or occupied injuriously to affect the use, occupation or value of the adjacent
premises. "
. "No animals or pets of any kind shall be kept upon said property except ordinary
household pets which shall not be a nuisance or annoyance to the neighbors."
"No repairs or restorations of any motor vehicle, boat, camper, trailer or other
vehicle shall be permitted on any lot unless such repairs are conducted in an enclosed
garage nor shall any non-operable vehicle be regularly kept on a lot except in an
enclosed garage"
“Unless approved by the ACC, no outside antennae of any type including, but not
limited to satellite dishes, shall be maintained or constructed on any lot."
“The keeping or storing of any recreational vehicle, including a pickup camper,
mobile home or travel trailer, or any boat, house boat or boat trailer on any lot is
prohibited unless the same be housed completely within the garage."
“No vehicle or trailer shall be parked, stored or otherwise left on any unpaved
area”
8. The Master Declaration of Covenants and Restrictions, Article VIII, states "If
any person, corporation or other legal entity shall violate or attempt to violate any
of these covenants or restrictions, it shall be lawful for… the ACC or the Association
to prosecute proceedings for the recovery of damages against those so violating or
attempting to violate any such covenants or restrictions or to maintain an action in
any court of competent jurisdiction against those so violating such restrictions for
the purpose of preventing or enjoining all or any such violations or attempted
violations"
9. Homeowners shall obtain written approval from the ACC before construction of
any building, fence, wall, mailbox or other improvement or structure shall be commenced,
erected, placed, moved or maintained upon the property, or before any addition to or
change or alterations to the exterior or the color thereof are made. The ACC shall
evaluate all such requests for harmony of external design, color, materials, and location
in relation to surrounding structures and environment and conformity with the design
concept of the community. Homeowners shall comply with all restrictive covenants and
keep their lots mowed and properly maintained, and shall repair their dwelling unit and
other improvements, keeping the same in a condition comparable to the condition of such
residence and other improvements at the time of its initial construction, excepting only
normal wear and tear.
To obtain ACC approval for construction, improvements, additions, changes
alterations, submit a completed Request for Exterior Change form to the management
company.
Include a thorough description of the proposed project and attach blueprints,
scale drawings, brochures, pictures, or other pertinent materials to facilitate a
prompt review by the ACC. The homeowner is responsible for any licenses or permits
required by state or local authorities.
The ACC will review homeowners' requests for harmony of external design,
color, materials, and location in relation to surrounding structures and environment
and conformity with the design concept of the community, and inform the homeowner if
the ACC deems it necessary to obtain an opinion from a licensed civil engineer or
other expert in order to evaluate a request. The cost for a civil engineer or expert
will be paid by the homeowner. The ACC will ensure the homeowner receives written
approval or rejection within 30 days of receipt of a Request for Exterior Change form,
The ACC will conduct an inspection of completed projects to ensure they are in
compliance with specifications approved by the ACC.
In the event the final inspection indicates a project has been completed
other than in accordance with a plan and specifications approved by the ACC, then
the project shall be considered to have been undertaken in violation of the Master
Declaration of Covenants and Restrictions, Article V, and upon written notice from
the ACC such shall be removed or corrected. In the event that the correction Is
not completed within 15 days of notice of such violation delivered to the owner of
the lot where such violation exists, then the ACC as agent for the Association shall
have the right to secure enforcement as provided in the Master Declaration of Covenants
and Restrictions, Article VIII.

Any and all changes to the exterior such as the roof, or appearance is to be receive approval from the ACC before starting.
